This contract describes the general terms and conditions applicable to the use of the products and offered through the site https://kalexa.es/en/ which is owned by Katy Alexandra Pimentel Guzman, with NIE Y2026353K and fiscal address at Calle Playa de Gorliz 8 28290 Las Rozas de Madrid, Spain, hereinafter Kalexa.

It is a prerequisite for the purchase of the products offered on this site that you read and accept the following Terms and Conditions which are set out below.

In some cases, in order to purchase a product, it will be necessary for the user to register, enter reliable personal data and define a password (which will not be necessary if you want to place the order with a guest account).

The user can choose and change the password for their account management access at any time, in case they have registered and it is necessary for the purchase of any of our products. Kalexa accepts no liability if you give this key to third parties.

All purchases and transactions made through this website are subject to a confirmation and verification process, which may include verification of stock and product availability, validation of the payment method, validation of the invoice (if any) and compliance with the conditions required by the selected payment method. Verification by e-mail or telephone may be required in some cases (e.g. for chargebacks).

The prices of the products offered in this Online Shop are valid only for purchases made on this website.

LICENSE TO USE WEB

Kalexa, through its website grants a license for users to use it in accordance with the Terms and Conditions described in this document.

SHIPMENT COSTS

Shipping costs are free from 49€ for mainland Spain and 99€ for Portugal.

In case these figures are not reached: shipping your orders to Peninsula costs €3.90, and to the Balearic Islands costs €5.90. To the Canary Islands, Ceuta and Melilla, the shipping price is 9,90€ + customs duties.

Shipping to other EU countries costs €9.90,

Shipments with reimbursement have an additional charge of 3€, this payment method is only available for Peninsular Spain, and for purchases over 20€ and under 100€ on the first purchase. All counter-refund orders are confirmed before dispatch, except for repeat customers.

The minimum order for shopping on https://kalexa.es/en/ is 15€, VAT included and transport excluded.

DELIVERY DEADLINES

Orders are dispatched in less than 24 hours, since all products for sale are in stock, so we do not make our customers wait unnecessarily. Orders arrive between 24 and 48 working hours in peninsular Spain, and 3/5 working days in the rest of the territories.

Shipping to other EU countries takes between 5 and 10 working days, except for Portugal, which takes between 2 and 4 working days.

From Kalexa we cannot guarantee these delivery times, since it does not depend on us, but on the transport company, what we can guarantee is that from our team the best management will be done so that your order is delivered in the shortest time possible.

Currently our main carrier is GLS. Usually this company sends an email informing you of the delivery time and offers you a link to change it or pick it up at the nearest office.

If your shipment within Peninsular Spain has not been delivered within the first 72/ 96 hours after being shipped, and you have not received information from the transport company, you should inform us via our WhatsApp 640320987.

Orders may be delayed during holiday and sale periods. Please note the estimated delivery date shown on the website.

REFUND AND GUARANTEE POLICY

If you are not satisfied with any item, (or you wish to exercise your right of withdrawal), you can return it within the first 14 calendar days after receipt, the item must be in the same condition in which it was received (labeled, unused, unwashed, without stains, perfume, etc.).

Returns are NOT accepted for OUTLET or BUSINESS items. This is indicated in the description of each product of these categories.

We recommend that you make the shipments CERTIFIED as Post does not deliver ordinary packages if they do not fit in a mailbox. Please note that the package must be in our premises within a maximum of 3 working days after the 14 calendar days from receipt.

Packages that are out of date will NOT be accepted. If you send items that cannot be returned, that are NOT previously approved, or party clothes that do not retain ALL the labels, they will be made available within 60 calendar days, so that you can manage their collection (always at the user's expense), once this period has passed these items will be donated to the Caritas charitable foundation.

For the convenience of its customers, and as long as the return is notified with a maximum of 5 days (after receipt of the item (s)) Kalexa gives you the option to manage the return by sending a courier to your home, for a cost of 7,90 €, this if the package is less than 1 kilo, if the package is a box or is equal to or greater than 1 kilo, the courier cost will be 9,90 €. For packages of 2 kg or more or boxes over 25 cm, we have no courier service. The cost of the courier shall be deducted from the corresponding amount to be returned. The courier service only applies to Peninsular Spain and is subject to availability.

Please note that shipping and return costs are always borne by the buyer, i.e. if after deducting the return on your purchase, it no longer exceeds 49€ (amount established for free shipping), the corresponding shipping cost will be deducted from the balance to be returned.

Once the refund process has been completed, the corresponding refund amount will be sent to you by e-mail in a code, this code will be automatically cancelled as soon as the refund is made by the same means in which you paid. For payment by bank transfer or against refund, if you want a refund of the amount, you must request it on the same e-mail of the voucher within the first 5 days of receipt, indicating an account or telephone number (in the case of Bizúm) for the refund. Otherwise, you will have the voucher available with your balance to use on the web with an expiration of one year.

In case of a tara, you must inform us and send photos to our WhatsApp 640320987, within 48 hours after receiving the article. Otherwise, conformity with the product or products shall be assumed and the same return procedure as described above shall be followed.

For returns of 3 items in one order, you will be charged a handling and packing fee of 2€ and 1€ for each additional item returned.

THE COMMISSION SHALL BE ASSISTED BY THE MEMBER STATES

The customer's purchase may be deferred for fraud verification. It can also be suspended for longer for more rigorous investigation, to prevent fraudulent transactions.

PRIVACY POLICY

Kalexa ensures that the personal information you send is kept secure. The data entered by the user or in the case of requiring a validation of orders will not be disclosed to third parties, unless it must be disclosed in compliance with a court order or legal requirements. Subscription to advertising e-mail newsletters is voluntary and may be selected when you create your account.

Kalexa does not store payment data. These are managed through payment gateways. We only store your name, address, telephone and email address. If you enter a password to create a customer account, it is also stored in our database, but in encrypted form.

If you wish to exercise your rights of rectification, deletion or access, you can do so by e-mail [email protected]. The response times shall be in accordance with the legislation in force under Spanish law.
